Welcome to Littlest. These terms are the agreement between you and Littlest Pty Ltd for your use of the Littlest app on iOS and Android, our website at littlest.ai, and the Littlest Plus subscription. By creating an account or using the app, you agree to these terms. Please read them.

1. Who can use Littlest

You must be at least 18 years old to create an account. Littlest is for parents and carers. Children do not use the app themselves. You are responsible for anything done through your account.

2. Littlest is information, not medical advice

Littlest helps you track your child's day and gives general parenting, feeding, sleep and wellbeing information. It is not a medical device, and it is not medical advice. Nothing in the app is a diagnosis, a treatment plan, or a substitute for care from a doctor, midwife, nurse or other health professional.

In an emergency, call your local emergency number straight away. In Australia that is 000. Some safety features in the app will point you to the right number for your region, but Littlest cannot call for you and cannot monitor your child.

Always talk to a health professional about your child's health, feeding, growth, medicines and development, and about your own physical and mental health.

3. Your account

Keep your sign in method secure. We do not store passwords: you sign in with an email code, with Google, with Apple, or you can start anonymously and link an account later. Tell us at admin@littlest.ai if you think someone else has access to your account.

The information you log should be accurate. Littlest organises what you enter, and the app's suggestions are only as good as the information behind them.

4. Acceptable use

Please do not:

  • Use Littlest for anything unlawful, or to harm, harass or endanger anyone.
  • Upload content you do not have the right to upload, or content about a child you are not a parent or carer of.
  • Try to break, probe or overload our systems, or get around security or usage limits.
  • Copy, scrape, resell or rent the service, or use it to build a competing product.
  • Use the AI coach to produce content that is unlawful, abusive or deceptive.
  • Impersonate anyone, or share your account with people you have not invited as a caregiver.

We may suspend or close an account that breaches these terms.

5. Sharing with partners and caregivers, and the household plan

You can invite a partner or caregiver to a child's record. They see the record you choose to share with them. Only invite people you trust with information about your child, and remove access when it is no longer needed.

One Littlest Plus subscription covers one household. That means the subscriber's own babies, and the caregivers the subscriber has invited onto those babies. Caregivers get Littlest Plus features on the babies they share, and do not need their own subscription for those babies. A caregiver who later starts their own babies needs their own subscription for those.

6. Littlest Plus subscription terms

Some features need a paid subscription called Littlest Plus.

  • Plans. Littlest Plus is offered as a monthly or an annual auto-renewing subscription.
  • Price. The price and the length of each period are shown in the App Store or Google Play at the point of purchase, in your local currency. Prices may vary by country and may change. If a price changes, you will be asked to agree before it applies to a renewal, in line with the store's rules.
  • Free trial. Eligible new subscribers may receive a three-month free trial where it is shown at purchase. The offer and eligibility are determined by the App Store or Google Play; returning subscribers may not qualify. Check the offer, price and billing period shown by the store before confirming. The trial converts into a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial is forfeited if you buy a subscription during the trial.
  • Auto-renewal. Your subscription renews automatically at the same price for the same period, unless you cancel at least 24 hours before the end of the current period.
  • Payment. Payment is charged to your Apple ID or your Google account, at confirmation of purchase and then at each renewal.
  • Managing and cancelling. Manage or cancel your subscription in your App Store account settings or in your Google Play subscriptions settings. Cancelling stops future renewals. You keep access until the end of the period you have paid for. Deleting the app does not cancel a subscription.
  • Refunds. Purchases are processed by Apple and Google, and refunds are handled by them under their own policies. Littlest cannot refund a store purchase directly. Nothing in these terms excludes the consumer guarantees you have under the Australian Consumer Law. If a service is not of acceptable quality or does not match its description, you may be entitled to a remedy. Contact us and we will help you with a store refund request.

7. Apple App Store terms (iOS users)

If you downloaded Littlest from the Apple App Store, Apple's standard Licensed Application End User License Agreement applies, and to the extent of any conflict between it and these terms, Apple's minimum terms prevail. In particular:

  • This agreement is between you and Littlest Pty Ltd only, not with Apple. Apple is not responsible for Littlest or its content.
  • Licence. You get a non-transferable licence to use Littlest on any Apple branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
  • Maintenance and support. Littlest Pty Ltd is solely responsible for maintenance and support. Apple has no obligation to provide either.
  • Warranty. If Littlest fails to conform to any applicable warranty, you may tell Apple and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the responsibility of Littlest Pty Ltd.
  • Product claims. Littlest Pty Ltd, not Apple, is responsible for addressing any claims about the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar laws.
  • Intellectual property. If a third party claims Littlest infringes their intellectual property rights, Littlest Pty Ltd, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You confirm you are not located in a country subject to a United States Government embargo or designated as supporting terrorism, and that you are not on any United States Government list of prohibited or restricted parties.
  • Developer contact. Littlest Pty Ltd, admin@littlest.ai, littlest.ai. Questions, complaints and support requests go to us.
  • Third party terms. You must comply with any applicable third party terms of agreement when using Littlest, such as your wireless data plan terms.
  • Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of these terms and have the right to enforce them against you.

8. Your content and our content

You own your content. The information, photos and videos you put into Littlest stay yours. You give us a licence to store, copy, transmit, display and process that content for one purpose only: to operate and improve the service for you, including sending the parts needed to answer a question to the providers listed in our Privacy Policy. We do not sell your content and we do not use it for advertising.

You confirm you have the right to upload what you upload.

We own our content. The Littlest app, its name, logo, design, text and software are owned by Littlest Pty Ltd or our licensors. These terms do not give you any rights in them beyond using the app.

9. AI output

Littlest includes an AI coach. AI output can be incomplete, out of date, or simply wrong, even when it sounds confident. Treat it as a starting point, not an answer. Check anything that matters, especially anything about health, medicines, feeding or safety, with a health professional. Do not rely on the AI coach in an urgent or emergency situation.

10. Availability and changes to the service

We work hard to keep Littlest available, but we cannot promise it will be uninterrupted or error free. We may add, change or remove features, and we may need to take the service down for maintenance.

11. Liability

To the extent permitted by law, Littlest Pty Ltd is not liable for indirect or consequential loss, loss of data, or loss of profits arising from your use of the service, and our total liability is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Where we are permitted to limit a remedy for a breach of a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.

12. Ending your use

You can stop using Littlest at any time and delete your account in the app under Settings > Delete account, or Confidentiality > Delete. Deleting your account does not cancel a store subscription, so cancel that in the App Store or Google Play as well.

We may suspend or close your account if you breach these terms, if we are required to by law, or if we stop offering the service. If we close the service, we will give you reasonable notice and a way to get your data out.

13. Changes to these terms

We may update these terms. We will change the date at the top, and for significant changes we will tell you in the app or by email. If you keep using Littlest after a change takes effect, you accept the updated terms.

14. Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. If you live somewhere else, you keep any rights you have under your local consumer law.
